1. Acceptance of Terms

By accessing or using SnapIQ™ (the "Platform"), developed and operated by Locke-N-Roll, LLC ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

2. Permitted Use

SnapIQ™ is an educational and administrative tool intended for use by licensed educators, special education professionals, school administrators, and authorized parents or guardians. You agree to use the Platform only for lawful purposes and in accordance with these Terms.

3. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You must notify us immediately of any unauthorized use of your account.
• You may not share your account with others or create accounts on behalf of others without authorization.

4. Student Data and FERPA Responsibilities

You acknowledge that student data entered into SnapIQ™ is sensitive and protected by applicable laws, including FERPA.

• User Responsibility: You agree to only enter student data for students you are legally authorized to serve, and to handle that data in compliance with your school or district's policies.
• Pseudonymization: You agree to strictly omit Personally Identifiable Information (PII) from student profiles. Students must only be identified within the Platform using initials and arbitrary ID numbers.
• School Official Status: In providing this service, Locke-N-Roll, LLC operates under the "School Official" exception of FERPA, processing data strictly under your direct control and solely for the authorized educational purpose.

5. AI-Generated Content and Limitation of Professional Liability

SnapIQ™ utilizes artificial intelligence to assist educators in generating reports and analyzing data.

• Assistance Only: The Platform is an administrative tool, not a substitute for professional medical, psychological, or specialized educational evaluation.
• User Verification: You, the educator, are solely responsible for reviewing, verifying, and editing all AI-generated content before presenting it in official capacities, including but not limited to IEP (ARD) meetings, parent conferences, or medical evaluations.
• No Reliance: Locke-N-Roll, LLC assumes no liability for the accuracy, clinical validity, or outcomes of any reports generated by the Platform.

6. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using the Platform to harass, harm, or discriminate against any individual.
• Uploading illegal, offensive, or inappropriate content.
• Uploading student records containing full names, social security numbers, or unredacted PII.
• Attempting to gain unauthorized access to other users' accounts or data.
• Reverse engineering, scraping, or attempting to extract the source code or proprietary AI prompts of the Platform.

7. Intellectual Property

All content, branding, technology, and proprietary workflows within SnapIQ™ are the exclusive property of Locke-N-Roll, LLC. You may not reproduce, distribute, or create derivative works without written permission.

8. Disclaimer of Warranties

SnapIQ™ is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Platform will be error-free, entirely secure, or uninterrupted. Use of the Platform is strictly at your own risk.

9. Limitation of Liability and Indemnification

To the fullest extent permitted by law, Locke-N-Roll, LLC, its developers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, data loss, or reliance on AI-generated reports.

You agree to indemnify and hold harmless Locke-N-Roll, LLC from any claims, damages, liabilities, or expenses (including legal fees) arising from your failure to comply with FERPA, your uploading of unredacted PII, or your misuse of the Platform.

10. Changes to Terms

We may update these Terms at any time. Continued use of SnapIQ™ after changes constitutes acceptance of the new Terms.
